A Model X owner has filed a lawsuit against Tesla Motors, claiming that the SUV suddenly accelerated while it was being parked, causing it to crash through his garage and into the living room.
Ji Chang Son maintains in the lawsuit that he and a passenger sustained injuries in September when “the vehicle spontaneously began to accelerate at full power, jerking forward and crashing through the interior wall of the garage, destroying several wooden support beams in the wall and a steel sewer pipe, among other things, and coming to rest in Plaintiffs’ living room.”
Filed in U.S. District Court in the Central District of California, the lawsuit is attempting to secure class action status, citing seven other complaints of sudden acceleration that have been reported to the National Highway Traffic Safety Administration (NHTSA). The lawsuit seeks unspecified damages and alleges product liability, negligence and breaches of warranty.
For its part, Tesla says that the automaker has conducted an investigation into the incident and concluded that “the evidence, including data from the car, conclusively shows that the crash was the result of Mr. Son pressing the accelerator pedal all the way to 100 percent.”
Introduced in late 2015, Tesla promotes the Model X as the safest SUV ever produced.
